A Note on Emergencies

This Site, our scheduling tools, and any email or messaging with our office are not monitored continuously and are not intended for use in a medical or mental health emergency.

If you or someone you know is in crisis, in danger, or having thoughts of suicide or self-harm, please do not wait for a response from us. Call 911, go to your nearest emergency room, or contact the 988 Suicide & Crisis Lifeline by calling or texting 988 (available 24/7 in the United States).

Overview & General Conditions

This website, discoveringmyself.com (the "Site"), is operated by Dr. Robert B. Hernández-Cruz, Psy.D., doing business as Discovering Myself ("Discovering Myself," "we," "us," or "our"). Throughout the Site, these terms refer to psychotherapy, coaching, and psychological evaluation services collectively as the "Services."

By visiting the Site, scheduling a consultation, or engaging any of our Services, you agree to be bound by these Terms of Service ("Terms"), including any additional policies referenced here or made available to you separately, such as our Privacy Policy and, where applicable, our Notice of Privacy Practices. These Terms apply to all visitors, prospective clients, current clients, attorneys and other professional referral sources, and anyone else who accesses the Site.

Please read these Terms carefully before using the Site or engaging our Services. If you do not agree to all of these Terms, please do not use the Site or engage our Services.

We may update, change, or replace any part of these Terms at any time by posting the updated version on this page. It is your responsibility to check this page periodically. Your continued use of the Site following any posted changes constitutes acceptance of those changes.

SECTION 4 — SCHEDULING, CANCELLATION, & FEES

Where offered, virtual (telehealth) sessions are provided only to clients who are physically located, at the time of the session, in a jurisdiction where Dr. Hernández-Cruz is authorized to practice. As of the date of these Terms, that includes Florida, New York, and states participating in the Psychology Interjurisdictional Compact (PSYPACT). [Confirm the current PSYPACT member states you are authorized to practice in, since PSYPACT's participating states change over time, and keep this list current.]

If you are physically located outside of an authorized jurisdiction at the time of a scheduled telehealth session, we may be legally unable to provide that session, and you agree to inform us of your location before each virtual session upon request.

Telehealth carries inherent limitations compared to in-person care, including the potential for technology failures, limitations in physical observation, and considerations specific to your location and circumstances. Additional telehealth-specific consent details will be provided and signed separately as part of intake.

SECTION 1 — WHO MAY USE THIS SITE?

By using this Site, you represent that you are at least the age of majority in your state of residence, or that you are accessing the Site on behalf of a minor with the authority to do so (for example, as a parent or legal guardian arranging services for a minor client).

You may not use the Site for any unlawful or unauthorized purpose, and you may not, in using the Site, violate any law in your jurisdiction, including intellectual property law. You must not introduce any virus, worm, or other malicious code. A breach of these Terms may result in immediate termination of your access to the Site and, where applicable, suspension of services.

SECTION 2 — THE NATURE OF OUR SERVICES

La Farfalla Retreat, Inc. provides several distinct types of professional services, and the relationship formed, the confidentiality protections that apply, and the purpose of the work differ depending on which service you engage:

- Individual Jungian-oriented psychotherapy is a clinical treatment relationship intended to support your mental health and well-being. It is confidential, subject to the limits described in our Notice of Privacy Practices and applicable law.

- Professional growth coaching is not psychotherapy and is not a substitute for mental health treatment. Coaching does not create a doctor-patient relationship, and coaching sessions are not treated as protected health information in the same manner as psychotherapy records unless otherwise stated in a separate coaching agreement.

- Immigration psychological evaluations (including waiver/extreme hardship, VAWA, asylum, U-Visa, and competency evaluations) are forensic or evaluative in nature. These engagements are typically initiated by, or for the benefit of, a referring attorney or third party, and the resulting written report may be shared with that attorney, the court, or U.S. Citizenship and Immigration Services (USCIS). Because of this, evaluations are not confidential in the same way psychotherapy is, and no traditional therapeutic relationship is formed with the person being evaluated solely by virtue of the evaluation. The specific confidentiality terms of any evaluation will be described in a separate evaluation agreement or informed consent document signed before the evaluation begins.

Scheduling an appointment or submitting an intake form through the Site does not, by itself, establish a clinical, coaching, or evaluative relationship. That relationship begins only once intake is complete, and both parties have agreed to move forward.

Scheduling links and intake procedures differ by service and are provided directly to you as part of the referral or consultation process.

For all services, payment must be made the day before the session to confirm the appointment; otherwise, the appointment will be canceled. Each appointment is considered a completed service, and no refunds are issued once attended.

As a courtesy, insurance claims will be billed on behalf of the client, and the client will be reimbursed at the rate of the individual plan policy of their insurance carrier.

Cancellation Policy

Clients will be billed for a "No-Show" session if the session is not canceled at least the day before, and the client has paid for the session before the cancellation, according to the above policy. Emergencies are not billed solely at the psychologist's discretion. This is due to the mutual respect for the time of both participants in the session. This also allows another client in need of a session to be scheduled.

Fees for psychotherapy, coaching, and evaluation services are provided to you before services begin and are subject to change. Fees for evaluation services, including standard and rush processing, expert witness testimony, and any additional fees, will be confirmed with you or your referring attorney in writing before the evaluation begins. We reserve the right to update our fees at any time; changes will not apply retroactively to services already in progress.

Accepted payment methods: credit/debit card, Paypal, and Zelle.

SECTION 5 — ACCURACY, COMPLETENESS, AND TIMELINESS OF INFORMATION ON THIS SITE

Content on this Site, including blog posts, podcast episodes, and social media content linked from the Site, is provided for general educational and inspirational purposes only. It is not personalized medical, psychological, or legal advice, and it is not a substitute for an individualized clinical assessment, therapeutic relationship, or consultation with a licensed professional. Any reliance on Site content in place of professional consultation is at your own risk.

We reserve the right to modify Site content at any time and have no obligation to update it. Historical content, including older blog posts or podcast episodes, may not reflect our current views, services, or credentials.

SECTION 6- MODIFICATIONS TO SERVICES

We may modify, pause, or discontinue any Service, or any part of the Site, at any time, with or without notice. We are not liable to you or any third party for any modification, fee change, suspension, or discontinuation of a Service, except as required by an existing signed service agreement between us.

SECTION 7- NO GUARANTEE OF OUTCOMES

We do not and cannot guarantee any particular outcome from psychotherapy, coaching, or evaluation services, including but not limited to symptom improvement, personal growth outcomes, or the outcome of any immigration case, court proceeding, or USCIS decision. Immigration and legal outcomes depend on many factors outside our control, including decisions made by attorneys, judges, and government agencies. A psychological evaluation report is one piece of evidence among many and does not determine the outcome of a legal or immigration matter.

SECTION 8 — CONFIDENTIALITY & PRIVACY

If you are a psychotherapy client, your protected health information is additionally governed by our Notice of Privacy Practices, provided to you separately at the start of care, in accordance with HIPAA.

If you are undergoing a psychological evaluation, the confidentiality of that evaluation, and who it may be shared with (such as your attorney or the court), will be explained to you in a separate evaluation-specific informed consent document before the evaluation begins.

We do not sell your personal information. Any transmission of information over the internet, including through our website or third-party scheduling tools, carries inherent security limitations, and you acknowledge this when you choose to submit information electronically.

SECTION 9 — OPTIONAL TOOLS AND THIRD-PARTY LINKS

We may link to or use third-party tools that we do not control, including scheduling platforms, payment processors, insurance verification tools (such as Headway), and video-conferencing software for telehealth sessions. We provide access to these tools "as is" and "as available," without warranty, and we are not responsible for their functionality, security, or availability.

The Site may also link to third-party content that is not affiliated with us, including our book, "Masculine Revolution," which is sold through Amazon and governed entirely by Amazon's own terms of sale, and our social media channels (Instagram, Facebook, TikTok, YouTube, and our "Let's Reunite!" podcast), each governed by that platform's own terms. We are not responsible for the content, accuracy, privacy practices, or availability of any third-party site or platform, and any transaction or interaction you have with a third party is solely between you and that third party.

SECTION 10 — USER COMMENTS, FEEDBACK, & SUBMISSIONS

If you send us comments, testimonials, reviews, questions, or other submissions through the Site, by email, or by social media, other than protected health information submitted as part of clinical care, you agree that we may use, edit, and share that submission (for example, in marketing materials), unless you tell us otherwise. We are under no obligation to keep such submissions confidential, compensate you for them, or respond to them.

You agree not to submit anything unlawful, threatening, defamatory, obscene, or that infringes someone else's rights, and not to impersonate another person. You are solely responsible for the accuracy of anything you submit.

This section does not apply to protected health information you share with us as part of your care, which is governed by Section 8 above and applicable law, not by this section.

SECTION 11 — ERRORS, INACCURACIES, & OMISSIONS

The Site may occasionally contain typographical errors, inaccuracies, or outdated information, including outdated descriptions of our services, credentials, or fees. We reserve the right to correct these at any time without prior notice. We are not obligated to update or clarify older content except as required by law.

SECTION 12 — PROHIBITED USES

You may not use the Site (a) for any unlawful purpose; (b) to solicit others to perform unlawful acts; (c) to violate any applicable regulation or law; (d) to infringe our intellectual property or anyone else's; (e) to harass, abuse, defame, or discriminate against anyone; (f) to submit false or misleading information; (g) to upload viruses or malicious code; (h) to collect or track others' personal information without consent; (i) to spam, phish, or scrape the Site; (j) for any obscene or unlawful purpose; or (k) to interfere with or circumvent the security of the Site. We may terminate your access to the Site for violating any of these terms.

SECTION 13 — DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

The Site and its content are provided "as is" and "as available," without warranties of any kind, either express or implied, to the fullest extent permitted by law. This disclaimer applies to the Site and its content; it does not limit or override any separate professional consent, treatment agreement, or evaluation agreement you sign in connection with clinical or evaluation services, which are governed by their own terms and by applicable professional standards of care.

To the fullest extent permitted by law, La Farfalla Retreat , Inc., Dr. Hernández-Cruz, and our affiliates, employees, and contractors are not liable for any indirect, incidental, punitive, special, or consequential damages arising from your use of the Site, including lost data or lost opportunities, even if advised of the possibility of such damages. Nothing in this section is intended to limit liability in a manner not permitted by applicable law or by professional licensing regulations governing psychological practice in Florida, New York, or any other jurisdiction where services are provided.

SECTION 14 — INDEMNIFICATION

You agree to indemnify and hold harmless La Farfalla Retreat, Inc., Dr. Hernández-Cruz, and our affiliates, employees, and contractors from any claim, including reasonable attorneys' fees, arising from your breach of these Terms, your violation of any law, or your violation of the rights of a third party, except to the extent such claim arises from our own negligence or misconduct.

SECTION 15 — SEVERABILITY

If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.

SECTION 16 — TERMINATION

These Terms remain in effect until terminated by you or by us. You may stop using the Site at any time. We may terminate or suspend your access to the Site if you fail to comply with these Terms. Termination of Site access does not, by itself, terminate an existing clinical, coaching, or evaluation relationship, which is governed separately by its own treatment or service agreement and applicable professional standards regarding termination of care.

SECTION 17 — ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any Notice of Privacy Practices, evaluation agreement, or treatment consent you separately sign, make up the entire agreement between you and La Farfalla Retreat, Inc. regarding use of the Site. Where a signed clinical, coaching, or evaluation agreement conflicts with these Terms on a matter specific to that service, the signed agreement controls.

SECTION 18 — GOVERNING LAW

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions, except where the law of another jurisdiction is required to apply to services rendered to a client located in that jurisdiction (for example, a telehealth client located in New York or another PSYPACT state at the time of service). [An attorney should confirm this governing law approach works appropriately across your multi-state telehealth practice.]

SECTION 19 — CHANGES TO THESE TERMS

We may update these Terms at any time by posting the revised version on this page. Your continued use of the Site after changes are posted constitutes your acceptance of those changes.
